1. Introduction

Thank you for visiting our Terms & Conditions. Please read the terms below and our Privacy Policy as you must agree to both documents in order to have permission to use our Services.

2. Definitions of terms

Below there is a list of words and phrases used throughout this agreement.
  • “Agreement” – refers to this Terms & Conditions;
  • “Software” – refers to the softwares we provide here on avrasys.com
  • “Avrasys” – refers to our company known as Avrasys Kft. The company is organized and exists under the laws of Hungary.
  • “Customer/User” – refers to anyone who purchases a product or service from avrasys.com

3. Licence Policy

You are granted permission to install and use our softwares on any number of domains you own. You are not allowed to install the software(s) you purchased from us on domains you do not own i.e. for your clients. The license by itself is non-transferable, but you can sell your site with the software(s) installed.

From the date of the purchase, Customer is granted access to software updates for the purchased software indefinitely if the software is sold with a one-time fee licence or until Avrasys continues to provide its services. If the purchased product is subscription based, the Customer is granted access to software updates during the subscription period. After the subscription period is expired, the Customer may renew his/her subscription to gain access to software updates again.

The Customer is strictly prohibited to share or resell his or her License.

4. User conduct

Abusive behavior not limited to swearing, cursing, insulting, and or threatening behavior towards Avrasys and its staff or customers is strictly forbidden. Personal abuse of ANY kind will result in immediate termination of service. In this event the customer will not be issued ANY refund.

It is the customers duty to keep Avrasys informed of any changes of their personal details. This includes, but not limited to your email address, mailing address and telephone number. E-mail is the preferred contact method for general communication. Avrasys will not be held responsible for any loss of communication or problems that arise as a result of customers not informing Avrasys of their current and accurate contact details. Although Avrasys will make the best efforts to provide quality and uninterrupted services this is not guaranteed. Avrasys will not be responsible for any damages a service interruption may cause to the client.

5. Fees & Prices

Avrasys reserves the right to modify or discontinue, temporarily or permanently, prices of all products or renewals, at any time with or without notice.

All prices are inclusive of VAT. All prices are displayed in US Dollar ($).

Avrasys accepts the following payment methods:

  • PayPal
  • Barion Smart Gateway for credit card payment

PayPal Holdings Inc. trading as PayPal, is an American company operating a worldwide online payments system that supports online money transfers and serves as an electronic alternative to traditional paper methods like checks and money orders.

Barion Payment Zrt. (established in 2015) holds an Electronic Money Issuer licence (from the Hungarian National Bank) and can serve customers across the EEA through passporting without any further licence.

6. Refund Policy

Since Avrasys is offering non-tangible irrevocable, digital goods, we do not generally issue refunds after the purchase is made, which you are responsible for understanding before purchasing any of our products or services. We are happy to answer any pre-sales questions you may have.

We may consider a refund for the purchased product, provided that all the following criterias have been met:

  • You have tried to resolve your issue with Avrasys technical support
  • Our support staff has determined that the purchased product cannot be installed in your server environment

Please note that we do not bear any responsibility and therefore we do not offer any refund requests based on incompatibility of our products with some third-party software (plug-ins, themes etc.). We do not guarantee that our products are fully compatible with any third-party softwares and we do not provide support for third-party applications.

No refunds will be issued more than fourteen (14) days after purchase of our software.

7. Support Policy

Technical Support is provided via email to customers. Support services are non-transferable, they are only available to the customer that purchased our software(s).

We only support our software(s). Our Support Service includes assistance with software installations, configuration and use. We provide our Softwares as is. We do not customize our Software or support any Third Party customizations of our Software. A customization is anything that changes the way our Softwares look or function relative to how we make our Software available to you.

8. Changes to the Services

Avrasys may change any aspect of this Terms & Conditions on written notice to you. These changes may include discontinuing aspects of the Avrasys Services in its entirety. In the event we do make any changes to any aspect of this Terms & Conditions, we will publish updated Avrasys Service information in our blog.

9. Copyright Infringements

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place through unlawful Avrasys service or services by sending complaint to us. Upon receipt of the notice, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged material from our site or service. The notice must include the followings:

  • full names and address of the complainant
  • written or electronic signature of the complainant
  • identification of the right that has allegedly been infringed
  • identification of the material or activity that is claimed to be the subject of unlawful activity
  • the remedial action required to be taken by Avrasys in respect of the complaint
  • contact details of the complainant
  • a statement that the complainant is acting in good faith
  • a statement by the complainant that the information in the take-down notification is to his or her knowledge true and correct

All intellectual property rights to our software developed or made available to the Customer on the basis of the Agreement shall remain exclusively vested in Avrasys, its licensors or its own suppliers. The Customer shall only acquire those rights of use that are explicitly granted in these General Terms and by law. Any rights of use granted to the Customer shall be non-exclusive, non-transferable to third parties and non-sublicensable.

10. Warranty

Our Software(s) are guaranteed to function on a clean server installation or when activated without any changes. Once you modify any of the software files or include third party applications, then we cannot guarantee that the software(s) will work. We cannot guarantee that software(s) will function with all 3rd party components, plug-ins or web browsers. Browser compatibility should be tested against the demonstration pages of the individual software before making a purchase.

11. Miscellaneous

This Agreement shall all be governed and construed in accordance with the laws of Hungary applicable to agreements made and to be performed in Hungary. You agree that any legal action or proceeding between Avrasys Kft. and you for any purpose concerning this Agreement or the parties’ obligations hereunder shall be brought exclusively in a state court of competent jurisdiction sitting in Hungary.
